Owner responsibility for fair wear and tear
The RTA states that owners or property managers are responsible for repairs needed because of fair wear and tear. Ageing materials and deterioration through normal use are not the same as damage caused by an occupant.
Tenant responsibility for damage
Tenants can be responsible for damage caused by them, their guests or, in some cases, pets. A clear example is impact damage such as a broken door, large wall hole or cracked item caused by an incident rather than normal use.
Why the original condition matters
The property should not be assessed as if every item were new. Age, prior condition and existing wear matter. Good entry photos and reports make this easier to establish.
Repair first or resolve responsibility first?
Owners often need the property repaired quickly so it can be re let. The commercial need to repair does not necessarily mean the cost responsibility has been agreed. Keep invoices, photos and condition evidence.
A practical workflow
Document the damage, confirm the repair scope, keep before and after photos, retain invoices and deal with any payment dispute through the appropriate tenancy process.
